Terms of Service

1. Acceptance

Jamistry ("the Service") is operated by Bluepeak Works Ltd, a company registered in England and Wales (company no. 17289177) with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Who may use the Service

You must be at least 13 years old to use Jamistry. If you are under 16 and located in the European Economic Area you may only use the Service with verifiable parental or guardian consent.

3. Your account

You are responsible for keeping your account secure. We use passwordless email authentication — do not forward magic-link emails to anyone else. Notify us at hello@jamistry.com if you suspect unauthorised access.

5. User-generated content

You retain ownership of tabs and other content you upload. By uploading content and marking it as "Shared", you grant Jamistry a non-exclusive, royalty-free licence to display and distribute that content to other users of the Service. You represent that you have the right to grant this licence.

If you submit a recording to the Jam Wall, you confirm that you have the right to share it and grant us a non-exclusive, royalty-free, worldwide licence to host, use, reproduce, adapt (for example, trim, caption, or annotate), and publicly display it — together with the caption, credit, and social media handles you provide — on the Jam Wall and in other Jamistry content and communications, including our official social media profiles, promotional and marketing material, and educational content. Submissions are reviewed before publication and may be declined or removed at our discretion. You can withdraw a published recording at any time by emailing hello@jamistry.com and we will remove it. Recordings may be submitted to the Jam Wall without creating an account; these Terms apply to such submissions all the same, and the age requirements in Section 2 apply to everyone appearing in a submitted recording.

We reserve the right to remove any content that violates these Terms or applicable law, without notice.

6. Intellectual property

The Jamistry name, logo, software, and machine-learning models are the property of Bluepeak Works Ltd and may not be copied or reused without written permission.

Instrument samples included in the Service originate from the tonejs-instruments collection and are used under the Creative Commons Attribution 3.0 licence. Sources: University of Iowa Musical Instrument Samples, VSCO2 Community Edition, Karoryfer Samples, and Freesound contributors.

7. Copyright complaints

We respect the intellectual property rights of others and expect users of the Service to do the same. If you believe that content hosted on the Service — for example a shared tab or a Jam Wall recording — infringes a copyright you own or represent, email a notice to hello@jamistry.com with the subject line "Copyright complaint", including:

We review valid notices promptly and remove or disable access to infringing material expeditiously. Where appropriate we will notify the user who uploaded the material. Accounts of users who repeatedly infringe copyright will be terminated. This procedure is intended to satisfy applicable notice-and-takedown requirements, including those of the UK Electronic Commerce (EC Directive) Regulations 2002 and the US Digital Millennium Copyright Act (17 U.S.C. § 512). Knowingly submitting a false or bad-faith complaint may expose you to liability.

If material you uploaded was removed following a complaint and you believe this was a mistake or misidentification, you may send a counter-notice to the same address including: identification of the removed material and where it appeared; a statement, under penalty of perjury where applicable, of your good-faith belief that the removal was mistaken; your name, address, and email address; your consent to the jurisdiction of the courts described in Section 12 (or, if you are in the United States, the federal district court for your address); and your physical or electronic signature. We may restore the material after a reasonable period unless the original complainant informs us they have sought a court order against you.

8. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, accuracy of transcriptions, or fitness for any particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance. Material changes will be notified by email.

12. Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
